Entry Requirements
This programme offers open access and targets all employees. When facilitators present the programme, they adapt the content to accommodate the literacy and numeracy levels of all participants. As a result, every employee can engage effectively with the material.
Purpose of the Programme
Legal liability refers to the responsibility that an individual or organisation has to compensate for harm or damage caused to another party due to actions or omissions. This responsibility may arise from breaches of statutory obligations, contractual agreements, or common law principles. Consequently, legal liability can lead to civil lawsuits, penalties, or other legal consequences, often requiring restitution or compensation to affected parties.
In the workplace health and safety context, legal liability specifically relates to injuries or illnesses that occur due to negligence or failure to comply with safety regulations. Therefore, employees and employers must understand their responsibilities to minimise risk.
The purpose of this skills programme is to equip learners to function as Essential Occupational Health and Safety (OHS) Compliance Ensurers. This role is legislated and applies across all occupations. Accordingly, all employees must understand and comply with essential OHS requirements linked to their work environment and job responsibilities. By doing so, they can reduce the risk of legal liability for both themselves and their organisations.
Learning Outcomes
Upon successful completion, learners will be able to:
- Apply operational knowledge of OHS legislation to identify and clarify potential personal legal liabilities within the workplace.
- Apply standard procedures to report workplace incidents, injuries, near misses, or hazardous conditions to the relevant supervisor or designated safety personnel. Through this process, learners help reduce the risk of legal liability.
- Apply essential safety methods by following established procedures, protocols, and guidelines provided by the employer. As a result, learners can minimise risks and help prevent workplace accidents and injuries.
Articulation Options
This part-qualification provides opportunities for various types of articulation:
Horizontal Articulation
Not applicable.
Vertical Articulation
Not applicable.
Diagonal Articulation
Not applicable.
Learning Opportunities
Learners may further develop their knowledge and skills through additional Occupational Health and Safety (OHS) programmes and related training courses. These opportunities support continuous improvement and career development.
Programme Duration and Assessment
The programme runs over two days and includes both theoretical and practical components. After completing all modules and achieving competency, learners may proceed to the Final Integrated Supervised Assessment (FISA).
The FISA consists of a written assessment that integrates all Exit Level Outcomes. It lasts a maximum of two hours and carries a total of 100 marks. Learners must achieve at least 70% to be considered competent.
During the FISA, learners must respond to a scenario that includes a range of questions and tasks. The assessment is supervised, and virtual sessions are recorded and camera-monitored to ensure integrity. Through this process, learners must demonstrate competence in the following areas:
- Occupational Health and Safety Legislation
- Health and safety principles, procedures, protocols, and guidelines
- Procedures
